FundEzy – Terms & Conditions

Welcome to FundEzy (“App”), owned and operated by Essor Ventures LLP, referred to as “FundEzy” “we,” “our,” or “us.” By downloading, accessing, or using FundEzy, you (“User,” “you,” or “your”) agree to be bound by these Terms & Conditions, our Privacy Policy, and all applicable laws and regulations. If you do not agree, please uninstall the App immediately.
1. Definitions
- “Fund Group” – A digital savings group created within FundEzy for pooled contribution and periodic payouts.
- “Member” – Any registered user participating in a fund group.
- “Contribution” – The periodic amount paid by each member toward the fund pool.
- “Payout / Winning Bid” – Amount disbursed to the selected member during each cycle (auction or allocation).
- “Commission / Platform Fee” – Charges collected by FundEzy for facilitating the group.
- “Verified User” – A user who has completed KYC and mobile verification.
2. Eligibility
To use FundEzy, you must:
- Be at least 18 years old.
- Be an Indian citizen with valid KYC documents.
- Have full legal capacity to enter binding contracts.
- Not be previously suspended or banned from FundEzy.
We may refuse registration or terminate accounts at our discretion.
3. User Account Registration
Users must provide accurate personal information during signup, including name, mobile number, and KYC details.
- One user may maintain only one account.
- You are responsible for maintaining the confidentiality of your login credentials.
- Any activity conducted through your account is considered your responsibility.
4. KYC Verification
FundEzy requires mandatory KYC verification to join groups or withdraw payouts. You agree to provide documents such as:
- Aadhaar
- PAN
- Bank account details
- Selfie verification
FundEzy reserves the right to validate, re-verify, or reject documents.
5. Formation & Operation of Fund Groups
5.1 Group Creation
- Groups may be created by FundEzy or by verified users (if enabled).
- FundEzy reserves the right to approve, reject, or dissolve any group.
5.2 Membership Rules
- Joining a group may require KYC, deposit, or credit score evaluation.
- Members must make timely contributions as per the group schedule.
5.3 Contribution Payments
- Contributions must be paid digitally through supported payment methods.
- Delayed payments may result in penalties, suspension, or removal.
5.4 Auctions / Payout Allocation
- Payouts may be allocated through: Digital Auction System, or Predefined Rotation / Random Allocation.
- Rules for bidding, winning limits, discount caps, and payout structure will be specified per group.
5.5 Fund Disbursement
- Payouts are processed only to bank accounts verified under the member’s name.
- FundEzy may delay further proceeding of the group for compliance or fraud checks.
6. Fees & Charges
FundEzy may levy:
- Platform fees
- Commission on payouts
- Penalties for late contributions
- Verification or processing charges
Fees are displayed during group creation/joining and may be updated anytime.
7. User Responsibilities
- Make timely payments.
- Not create fake accounts or submit fraudulent KYC.
- Not engage in harassment, abuse, or threats toward other members.
- Not use FundEzy for money laundering, illegal trade, gambling, or prohibited activities.
- Follow all app rules, notifications, and updates.
8. Default, Late Payments & Recovery
If a member fails to pay contributions on time:
- They may be barred from participating in auctions.
- Payouts may be withheld.
- The group may impose penalties, interest, or late fees.
- FundEzy may initiate internal recovery mechanisms or mediate disputes.
- Severe cases may be referred to legal collection.
FundEzy is not financially liable for member defaults but will assist groups in dispute handling.
9. Fund Handling & Liability Disclaimer
9.1 Nature of Service
FundEzy acts as a digital facilitator enabling users to form savings groups. FundEzy does NOT:
- Guarantee payouts
- Guarantee the performance of any user
- Provide loans or banking services
- Act as a financial institution
9.2 Security
FundEzy employs encryption and secure servers; however, no technology is 100% risk-free. Users accept the risk of digital transactions.
9.3 Limitation of Liability
FundEzy shall not be liable for:
- Loss due to member defaults
- Delay or failure of payments
- Technical issues, server downtime, API failures
- Unauthorized access caused by user negligence
- Loss of profits, revenue, or data
Maximum liability (if applicable by law) shall not exceed the platform fees paid by the user in the last 12 months.
10. Withdrawal & Refund Policy
- Contributions already used in active groups cannot be refunded.
- Wallet balances (if offered) can be withdrawn subject to verification.
- Processing fees may apply.
- FundEzy reserves the right to reverse transactions suspected of fraud or error.
11. Communication & Notifications
By using FundEzy, you consent to receive:
- SMS and WhatsApp alerts
- Push notifications
- Emails regarding transactions, reminders, updates, and promotional messages
You may opt out of promotional messages but not essential transactional notifications.
12. Prohibited Activities
You agree NOT to:
- Run Ponzi schemes or unauthorized finance operations
- Mislead members with false promises
- Abuse FundEzy for illegal activities
- Impersonate others
- Manipulate auctions
- Withdraw from a group without completing obligations
Violation may lead to account suspension, legal action, or financial penalties.
13. Dispute Resolution
13.1 Internal Resolution
Users must report disputes via:
- In-app chat support
- Email: support@fundezy.in
FundEzy will attempt mediation.
13.2 Arbitration
Unresolved disputes will be referred to binding arbitration under:
- Arbitration & Conciliation Act, 1996 (India)
- Venue: Bengaluru, Karnataka
- Language: English
14. Account Suspension & Termination
FundEzy may suspend or terminate accounts for:
- Fraud, abuse, or violation of T&C
- Fake documents
- Repeated defaults
- Misuse of the platform
Users may request voluntary account closure after settling all outstanding obligations.
15. Intellectual Property
- All logos, brand names, UI/UX, graphics, and content belong to FundEzy.
- Users may not copy, modify, distribute, or reverse-engineer the App.
16. Modification of Terms
FundEzy may update these Terms anytime. Continued use implies acceptance of updated terms.
17. Governing Law
These Terms are governed by the laws of India. Courts located in Karnataka shall have exclusive jurisdiction.
